California Residents for Tuition Purposes
Residents of California for tuition purposes are defined as individuals who have lived
in the state for at least one year and one day prior to the beginning of the semester,
who can demonstrate an intention to remain in California and who are allowed to establish
domicile in the United States. It is the student's responsibility to provide evidence
to support their claim of residency.
Students aged 18 to 19 may combine their parent's continuous residence in California
prior to their 18th birthday with their own continuous residence from their 18th birthday
onward in order to meet the one-year residency requirement.
For unmarried students under the age of 18, residency is determined by the legal residence
of their parents and/or guardians. A married minor establishes residency from the
date of marriage and must fulfill the one-year physical presence and intent requirement.
Nonresidents for Tuition Purposes
Nonresidents for tuition purposes are individuals who have lived in the state for
less than one year prior to the start of the semester, or who hold specific non-immigrant
visas that prevent them from establishing domicile in the United States.

International Students
International students attending on F-1 visas are nonresidents.

Military Personnel
Military personnel are classified as residents while they are stationed in California
for active duty. Their spouses and dependents are also considered residents during
the first year of active duty in California. However, they must provide proof of establishing
residency after that first year.
AB 540 Nonresident Tuition Exemption
Under California law (AB 540 and subsequent legislation), eligible students, including
certain undocumented students and others who are not eligible for residency, may qualify
for an exemption from nonresident tuition if they meet California educational attendance
requirements and submit the required affidavit.

Special Immigrant Visa (SIV) Holders and Refugee Students
Under California Education Code section 68075.6, eligible Special Immigrant Visa (SIV) holders and refugee students who settle in
California upon entry to the United States are granted a temporary exemption from
nonresident tuition.
This exemption is valid for up to one year from the date the student establishes residence
in California after entering the U.S. and applies to eligible individuals admitted
under federal SIV or refugee programs, including certain Afghan and Iraqi nationals
and their immediate family members.
